BREAKING: Court Nullifies Mohammed Ali’s Impeachment as Dekina LG Chair

A High Court sitting in Anyingba, has nullified the impeachment of Comrade Mohammed Ali nd ordered his immediate reinstatement as the substantive chairman of Dekina Local Government Area Council on Friday.

The presiding judge, Justice Rukayat Ayoola said the impeachment did not follow the procedure as required by the constitution in section 182, describing the process null and void.

She said the complainant was denied of the benefit of fair hearing, describing the impeachment as an affront against the principle of natural Justice and rule of law.

Ayoola, while given a declarative judgement saying, Hon Muhammed Ali should be reinstated as the chairman of Dekina Local Government Area immediately.

The Court said Ali, was equally entitled to his executive benefits while he was out of office as a result of the purported impeachment.

According to the judge, the impeachment of Mohammed Ali did not follow the procedure as required by the constitution, describing it as an affront against the principle of natural justice.

SavidNews recalled that Ali who was initially suspended on 9th July, 2014 following the resolution of the council’s lawmakers due to allegations of gross misconduct leveled against him, was finally impeached by the Council’s legislators on September 24, 2014.

Before his impeachment, Ali was elected Chairman of the Northern Local Government Chairmen Forum and becomes the first sitting chairman to be impeached in over a decade in Kogi State, who elected under the People Democractic Party.
