Nafiu Bala Gombe vs ADC: Court Fixes June 8 for Hearing of Leadership Suit

 

The Federal High Court in Abuja has adjourned the hearing of a suit challenging the leadership structure of the African Democratic Congress (ADC) under Senator David Mark to June 8, 2026.

The case was filed by Nafiu Bala Gombe, a former ADC National Deputy Chairman, who is asking the court to restrain the party’s caretaker leadership from continuing to present themselves as legitimate leaders of the party.

At Tuesday’s proceedings, Justice Peter Lifu granted the adjournment following a request by the plaintiff’s counsel, Robert Emukpoeruo (SAN), who cited the absence of lawyers representing parties seeking to be joined in the suit.

Counsel to the ADC, Shaibu Aruwa (SAN), informed the court that the previous judge had already entertained applications for joinder and urged that all affected parties be allowed to present their positions.

However, the plaintiff’s counsel insisted that the Supreme Court had directed an accelerated hearing of the matter and urged the court to ensure that all filings are completed before the substantive hearing begins.

Counsel representing the ADC faction led by Senator David Mark, Rauf Aregbesola and Ralph Nwosu did not oppose the application for adjournment.

Ruling on the matter, Justice Lifu noted that no party has the right to choose the judge to hear their case and emphasized the need for fair hearing for all parties.

The judge also ordered that all pending court processes be served within 24 hours and directed that parties complete filing their documents before the next hearing date.

The matter, marked FHC/ABJ/CS/1819/2025, challenges the legality of the current ADC caretaker leadership structure, alleging violations of the party’s constitution and the Electoral Act.
